Mid-Level Associate for Health Care and General Privacy Counseling

Job DescriptionDirect Counsel has partnered with a premere law firm to recruit a Mid-level Associate for Healthcare and General Privacy Counseling by adding an associate with four (4) to seven (7) years of experience in health care privacy and other areas of privacy law. We’re looking for an associate who can advise clients as they develop products and services; draft and update privacy policies, procedures, notifications, forms of consent, and related documents; and provide other general privacy counseling.
Our ideal candidate will have a solid understanding of:

Health information privacy (including human subjects research), and facility with federal (HIPAA) and state (CMIA, Washington My Health My Data Act, Nevada SB 370) health care privacy laws;

Consumer privacy;
-
Other federal privacy laws, such as GLBA, FCRA, COPPA, and the FTC Act;
-
Comprehensive state privacy laws, such as the CCPA;
-
International privacy laws and regimes, such as the EU’s GDPR; and
-
General technology and data flows.
Idea candidates also will have experience:

Drafting privacy policies;
-
Negotiating privacy-related contracts and data processing agreements (BAAs, DPAs, DUAs);

Providing product counseling;
-
Conducting privacy compliance assessments;
-
Drafting notifications for privacy and data security incidents; and
-
Advising clients on adtech issues (desirable, but not essential).

Candidates should have: superior academic credentials; excellent oral, written, and interpersonal skills; strong professional references; and

California, DC or New York bar membership (as appropriate) or eligibility to take the next available exam.
