Job Overview
Flanagan Law, APC is a full-service HOA law firm that handles all legal matters for our clients. We are seeking an attorney with strong litigation experience to join our growing legal team. The ideal candidate will possess a background in homeowners association law, although that is not necessary.

Key Responsibilities:

Legal Counsel and Advice

  • Provide legal guidance and support to the Board of Directors and association management.
  • Interpret and advise on the association’s governing documents, including bylaws, covenants, conditions, and restrictions (CC&Rs).
  • Analyze various laws affecting HOAs and provide legal opinions on Board questions and pending decisions.

Litigation

  • Represent the association in court proceedings and manage all aspects of litigation, including preparing and filing legal documents, appearing in court, and negotiating settlements.
  • Handle disputes related to property management, resident compliance, and other association-related matters.

Review and Drafting

  • Review, draft, and negotiate contracts and agreements on behalf of the association, including vendor agreements, maintenance contracts, and service agreements.
  • Draft amendments and restatements of Governing Documents to conform with current law and the needs of the community.

Compliance and Risk Management

  • Ensure the association's compliance with local, state, and federal laws and regulations.
  • Identify potential legal risks and develop strategies to mitigate them.

Dispute Resolution

  • Address and resolve conflicts between residents, board members, and management through mediation and negotiation.
  • Provide legal assistance in resolving issues related to property ownership, maintenance, and other association concerns.

Pay: $140,000-$200,000 per year (depends on experience), plus billable performance bonuses and bi-annual discretionary bonuses

Qualifications:

  • Juris Doctor (JD) degree from an accredited law school.
  • Active member in good standing of the CA Bar Association.
  • 5+ years of litigation experience.
  • Experience in real estate, property law, corporate law or condominium/HOA law is preferred.
  • Strong analytical skills with the ability to think critically and develop effective legal strategies.
  • Excellent communication skills, both written and verbal, to convey complex legal concepts clearly to clients and colleagues.
  • Strong negotiation and dispute resolution skills.
  • Ability to work independently and manage multiple tasks effectively.
  • High level of integrity and professionalism.
  • Adept at collaborating with other legal professionals to ensure thorough case management and representation.
  • Friendly and responsive client service is an absolute must.
